Lvivoblenergo to appeal SPF's sale of blocking stake in Dniproenergo to DTEK

Energy supply company PJSC Lvivoblenergo (controlled by Ihor and Hryhoriy Surkis) has appealed to the Kyiv Economic Court demanding that it invalidate the results of a tender on the privatization of a 25% stake in energy generating company Dniproenergo (now controlled by Rinat Akhmetov), held in 2012.

The relevant documents were published in the State Court Rulings Register.

The defendants in the case are the Cabinet of Ministers, the State Property Fund (SPF) and DTEK Holdings Ltd (Cyprus, the buyer of the stake).

The court decided to return the petition without consideration for formal reasons - because of the fact that Lvivoblenergo did not provide proof of sending copies of its statement to the defendants. However, the court upheld the right of Lvivoblenergo to apply again after the removal of defects.

As reported, DTEK in 2012 at a privatization tender acquired a 25% stake in power company PJSC Dniproenergo for UAH 1.180 billion. At the same time, the company of Rinat Akhmetov was the only participant in the tender.
