Kyiv Metropoliten asks PGO to study lawfulness of subway car leasing agreement with Ukrrosleasing

Kyiv Metropoliten municipal enterprise has asked the Public Prosecutor's Office to study the lawfulness of a subway car leasing agreement made in 2009 signed with Ukrrosleasing (Kyiv), which is affiliated with Yuriy Ivaniuschenko, Kyiv Metropoliten Director Viktor Brahinsky has said.

"The sorest point for Kyiv Metropoliten is Ukrrosleasing: today the subway owes UAH 950 million under the procedure for the purchase of the subway cars via the said leasing company. The program was approved by Kyiv City Council in 2009," he said, at a Kyiv City Council sitting on Thursday.

"The enterprise received cars and a large debt, as the agreement was signed between Kyiv Metropoliten and the leasing company. The defender is Kyiv Metropoliten. There were court hearings, criminal cases… We additionally applied to Public Prosecutor's Office, Interior Ministry and relevant agencies to protect the municipal company," Brahinsky said.

He said that the company does not have the grounds to apply to courts, as Ukrrosleasing won all the relevant hearings, even in the higher instance court.

"Nevertheless, we're working in this direction. We haven’t paid any kopeck. Thank God today there are not claims against the work on the collection of the funds from us, and we will hope only for support of the city and lawmakers in the settling of the issue," he said.

As reported, in July 2009, Ukrrosleasing LLC won a tender to lease 100 subway cars to Kyiv Metropoliten in 2009-2014.

The cars were bought using European Bank for Reconstruction and Development funds. The sum of the agreement was around UAH 1.391 billion. In August 2009, the Economic Development and Trade Ministry declared that the tender was invalid, as there was a lack of correspondence between tender documents and the bids.
