Dealer of Belkommunmash challenges victory of Bogdan Motors in tender to supply 7 trolleybuses to Khmelnytsky

BMK-Ukraine LLC (Lutsk), the official dealer of Belarussian manufacturer of trolleybuses Managing Company of Belkommunmash Holding has announced a winner of a tender to supply seven low-deck 12 meter trolleybuses to Khmelnytsky-based Electrotrans municipal enterprise after challenging the decision of the tender committee to declare Bogdan-Motors the winner in the Antimonopoly Committee of Ukraine.

According to a posting on the website of the ProZorro e-procurement system, three companies took part in the tender to supply trolleybuses for UAH 34.8 million – BMK-Ukraine, Bogdan Motors automobile plant No. 1 (Lutsk) and Ukrpastech LLC (Kyiv, the company offered Bogdan T701 trolleybuses).

At the tender, BKM-Ukraine LLC offered the lowest price after several rounds – UAH 33.42 million, while the final offer of Bogdan Motors was UAH 6,000 more – UAH 33.426 million.

However, the tender committee declared the offer of BMK-Ukraine LLC not complying with the qualification requirements (seeing the discrepancy in certificates for one model of a trolleybus) and declared Bogdan Motors the winner of the tender.

In turn, BKM-Ukraine appealed to the Antimonopoly Committee of Ukraine, filing a complaint where the company asked to annul the decision of the tender committee. The company said that its offer fully meets the tender conditions.

"The customer had the right to apply to the competent certification agencies for the purpose of verifying the information we indicated, but the customer did not knowingly apply, which may indicate its interest in concluding the contract with Bogdan Motors automobile plant No. 1," the company said in its complaint.

The committee satisfied the complaint of BMK-Ukraine and on November 14, 2017 an announcement on plans to sign the contract with BKM-Ukraine was posted in the ProZorro system.
