PGO chief calls for compromise between prosecution, defense team in border guard case

Ukrainian Prosecutor General Yuriy Lutsenko has said that Ukrainian border guard Serhiy Kolmohorov became a victim of Russian aggression and that a compromise will be found between prosecutors and defense lawyers during a repeated consideration of the case.

"In fact, the woman killed in the course of these events and the border guard, Senior Soldier Kolmohorov, became victims of this undeclared war. Both of them became victims and hostages of those events, and at some point we did not have proper legislative framework," he told journalists in Kyiv on Wednesday, November 8.

Lutsenko said that there were legal circumstances in this case, but the side of justice was no less important.

"We will have to find a balance, and I hope that the prosecution and the defense team will be united while debating and competing for the court's decision. We are united in ensuring that both the law and justice could give a precedent decision for the Ukrainian Armed Forces and all innocent victims of this war," Lutsenko said.

As reported, in September 2014, Kolmohorov, carrying out an order, used weapons to stop a car, killing a passenger.

On November 15, 2016, the Prymorsky District Court of Mariupol found Kolmohorov guilty of committing crimes under Part 1, Article 115, Part 3, Article 365 of the Criminal Code of Ukraine and sentenced him to 13 years in prison, depriving him of the right to hold posts of a representative of law enforcement agencies for three years and stripping him of the military rank "senior soldier."

Donetsk Regional Court of Appeal upheld the verdict of the court of first instance.

On November 6, the Higher Specialized Court for Civil and Criminal Cases sent the Kolmohorov case for a new trial to a court of first instance and released him from custody.
