Court declares Russia's Alfatex claim against AvtoKrAZ illegal

Ukraine's Supreme Court on March 25 upheld the position of PJSC AvtoKrAZ (Kremenchuk, Poltava region), the largest manufacturer of heavy trucks in Ukraine, in its dispute with Russia's Alfatex over funds worth $7 million.

According to a press release issued by FCLEX law firm, which represents the interests of AvtoKrAZ in court, the court again declared Alfatex's claim on recovering the said amount from AvtoKrAZ as illegal.

The press release said that Alfatex had appealed to court demanding that AvtoKrAZ return $7 million in 2013.

"Acting on the basis of a claim assignment agreement, Alfatex alleged the defendants failed to comply with the conditions of a contract for supplies," reads the report.

However, as previously stated by AvtoKrAZ, it has never worked directly with the complainant – the automobile company genuinely delivered trucks to a company with a similar name – Alfatex production and commercial enterprise - but it was liquidated several years ago and AvtoKrAZ had no obligations to it.

According to the press release, in October 2014 the court made a similar decision which upheld the position of AvtoKrAZ and in November of the same year the judges of cassation, based on the court recommendations, recognized the requirements of Alfatex as illegal.
