Almost half of lustrated Ukrainian officials appeal against dismissal – Justice Ministry

Out of 374 lustrated civil servants, nearly 170 have appealed against their dismissal, Director of the Lustration Department of the Justice Ministry of Ukraine Tetiana Kozachenko has said.

"There are currently nearly 170 proceedings in courts," she said at a press conference on Tuesday.

Almost half of the appeals have been filed by employees of the prosecutor's office, nearly 10% – by employees of the State Fiscal Service, 7% – by Interior Ministry's employees. The other appellants include employees of the Security Service of Ukraine. The majority of the appeals will be considered by courts in Kyiv, Cherkasy and Lviv regions.

According to Kozachenko the courts have ruled to reinstate two dismissed officials. However, appeals have already been filed against those decisions.

In addition, consideration of nearly 50% of cases has been delayed by judges until the Constitutional Court of Ukraine passes its judgment on the constitutionality of some of the provisions of the lustration law.

Kozachenko noted that according to the Supreme Court of Ukraine this only concerns judges, and that the delayed cases relate to the prosecutor's office employees.

She also noted that the judicial system resists lustration by delivering illegal judgments.

In particular, a judge in Bohunsky district court in Zhytomyr region decided to forbid the dismissal of a local office head of the Sate Fiscal Service of Ukraine until another case on paying alimony to his former wife is considered.

In addition, Kyiv court of appeals decided to delay the lustration of judges for six months, until summer 2015, though the court isn't authorized to do so.
