Rada speaker calling for amending law on amnesty of protesters

Verkhovna Rada Chairman Volodymyr Rybak has said the law on amnesties for Euromaidan participants should be amended.

The speaker has asked the leaders of the parliamentary factions to prepare as soon as possible their proposals to the law on eliminating negative consequences and preventing prosecution or punishment of individuals in regard to events that took place during peaceful rallies in Ukraine and submit them to parliament for consideration, the Verkhovna Rada's press service reported.

"Judicial practice has shown that within ten days from the date of its entry into force, namely by January 4, 2014, inclusive, this law cannot be applied in practice, as it has no precedent in the legislative practice and goes beyond the legal framework of our country," Rybak said in a letter to heads of the parliamentary factions.

"To further complicate matters, the vast majority of the provisions of the law are vague. Thus, the persons who are to be freed from prosecution are not defined, there is no list of criminal and administrative offenses for which these persons should be relieved from prosecution, and the responsibility to do this rests with the vaguely defined 'competent authorities,'" the speaker said.

According to Rybak, making amendments to this law will eliminate the legal conflict that has arisen and will allow freeing from prosecution those people who participated in mass rallies from November 21 through December 26, 2013.

Ukrainian President Viktor Yanukovych signed a law on eliminating negative consequences and preventing prosecution or punishment of individuals in regard to events that took place during peaceful rallies in Ukraine on December 23. The document took effect on December 26.

The law stipulates that all criminal cases opened against rally participants since November 21 should be closed and individuals should be released. These people are considered to have no convictions.

New criminal cases and cases on administrative offences cannot be open on participants of protest rallies or large-scale events held since November 21 until the law comes into effect.
