Revised lawsuit by U.S. firm against Tymoshenko groundless, says defense lawyer

The revised lawsuit of the U.S. company Universal Trading & Investment Co (UTICo) against former Ukrainian Prime Minister Yulia Tymoshenko is groundless, says the ex-premier's defense counsel, Serhiy Vlasenko.

"I am convinced that what they have added now has nothing to do with reality, and any normal sane judge will dismiss it all," Vlasenko told reporters on Monday near Central Clinical Hospital No. 5 in Kharkiv.

He noted that UTICo had filed several lawsuits against Tymoshenko, each time unsuccessfully.

"For ten years already in my memory UTICo has been trying to bring some claims against Yulia Volodymyrivna [Tymoshenko]. I have a clear understanding that the firm operates in full coordination with Ukrainian law enforcement agencies and with the Prosecutor General's Office in particular, with which, as far as I know, they have an agreement that it represents their interests in the United States. All that nonsense that Mr. Kuzmin (First Deputy Prosecutor General Renat Kuzmin) is saying, they repeat it on paper and they [the lawsuits] are being dismissed at regular intervals," Vlasenko said.

According to him, in 2004, U.S. District Judge Martin Jenkins, who examined the case of former Ukrainian Prime Minister Pavlo Lazarenko, having studied the materials of the U.S. Attorney General's Office on the case on financial abuse within the United Energy Systems of Ukraine Corporation (UESU), completely dismissed all the charges.

"I want to remind you, that in March 2004, Judge Jenkins, having considered the charges put forward by the U.S. Attorney General's Office in Lazarenko's case, including those dealing with UTICo company, completely dismissed all the charges related to alleged corruption in the UESU. The U.S. Attorney General's Office based its charges entirely on the information provided by the Ukrainian Prosecutor General's Office. All the theories, that Mr. Kuzmin is now trying to exploit, were set out there, including those about some alleged corrupt deals of the UESU etc. Judge Jenkins not only dismissed the case, he gave these materials to the jury because of lack of and any evidence and in his ruling (and I quote word by word) banned the government to use these false theories. So the U.S. court gave an absolutely clear assessment of these matters. Perhaps, the gentlemen from UTICo do not know this. But they will soon find out about it," Vlasenko said.

Media reported earlier, citing court documents, that the U.S. company UTICo had updated its lawsuit to the U.S. District Court for the Southern District of New York against former Ukrainian Prime Minister Yulia Tymoshenko and her associates in the part of the law of organized crime (RICO). Among the accomplices of the former prime minister, the company listed her husband Oleksandr Tymoshenko, former Deputy Minister of Finance of the Russian Federation Andrey Vavilov and ten other unidentified persons.
