High Court of England obliges Kolomoisky to agree on expenses on Belbek airport

The High Court of England and Wales believed that transactions of Ihor Kolomoisky to finance legal and other expenses of the Belbek airport (Sevastopol, Crimea) are non-standard and obliged the Ukrainian businessman to arrange the approval of these payments.

The decision published on Tuesday was made in the PrivatBank (Kyiv) case versus Kolomoisky, Hennadiy Boholiubov, as well as companies Teamtrend Ltd., Trade Point Agro Ltd., Collyer Ltd., Rossyan Investing Corp., Milbert Ventures Inc. and ZAO Ukrtransitservice Ltd., which allegedly belong to the businessmen or under their control.

According to the decision, Fieldfisher law firm, representing Kolomoisky, notified Hogan Lovells law firm (both based in the U.K.), representing the interests of PrivatBank, that large sums to finance court expenses in various cases should be sent, including this case.

Fieldfisher said that the funds will be sent by Stalmag SP z.o.o. from its account in IMG Bank Slaski (both based in Poland).

According to Kolomoisky, he holds 50% of the share capital of a company named in the case E Co., which holds 100% of shares in Stalmag appraised at $15 million.

The claimant doubted that the payments comply with the award of the High Court of England to arrest assets of the defenders issued in December 2017.

The court considered that this financing, including at Stalmag's expense, is not unreasonable or unacceptable. However, it said that the defendant - Kolomoisky - must coordinate the transactions with the claimant - PrivatBank.

The court also examined other Kolomoisky transactions, involving Selantia Limited, Atrasten Ventures Limited, Perkela Service Limited (all - Virgin Islands), Goiania Comercio E Servicos Internacionais LDA (Portugal), and Redhill Limited (Belize).

The High Court denied the need to coordinate these transactions under the asset freeze order.

The total amount of all transactions, together with the financing of the expenses of Belbek airport, is more than $40 million.
