Govt changes registration of ownership rights to land

The Cabinet of Ministers of Ukraine has amended the registration of ownership rights to land.

The resolution was approved at a government meeting on Wednesday.

According to the document, public registrars when drafting applications on the registration of land parcels in real-time mode are to check the conformity of the cadastre number of land parcels in the State Land Cadastre. The absence of this information in the cadastre would make impossible further steps and would result in the refusal to register ownership rights to land.

The resolution also approves legal mechanisms for verifying the existence of ownership rights to land parcels registered before 2013, which in the long term should avoid a "double lease".

According to the resolution, the registration of ownership rights to land parcels registered before January 1, 2013, is carried out if information about the parcels is outlined in the State Land Cadastre.

In addition, methods for correcting technical errors are determined in the event that the state registrar finds inaccurate or incomplete information about the owner of the land parcel. In this case, the state registrar must send an online message to the State Land Cadastre with information about the missing data and the cadastral registrar makes the necessary corrections.

In order to avoid abuses in the sphere of the registration of real estate, the procedure for identifying a person and checking his/her legal capacity during the registration activities are improved.

In addition, the possibilities of identifying a person for obtaining information from the public register of ownership rights to immovable property through the use of mobile electronic digital signature Mobile ID or other means are being expanded, which makes it possible to uniquely identify an individual.

Some clauses of this resolution will take effect on March 1, 2018.
