Kyiv's business court to hear competition agency's claim from Russia's Gazprom

Kyiv's business court has scheduled a hearing of a claim filed by Ukraine's Antimonopoly Committee asking to collect UAH 85.966 billion from Russia's Gazprom for October 31, 2106, the court has said.

As reported, Ukraine's higher business court dismissed a counterclaim of Gazprom against decisions of lower instance courts which returned without review its claim challenging the decision of Ukraine's Antimonopoly Committee to fine the Russian company UAH 85.966 billion.

The Antimonopoly Committee levied the fine on January 22, 2016, after determining that Gazprom had abused its monopoly position in transiting gas through Ukraine. However, Gazprom argues that the Antimonopoly Committee does not have the authority to regulate transit through Ukraine.

Kyiv's business court on April 13 dismissed the Gazprom's claim challenging the committee's decision.

The decision of Kyiv's appeal court dated May 18, 2016 in the case was left unchanged, and Gazprom's counterclaim filed on May 4 was dismissed.

Gazprom filed a counterclaim on June 7 to Ukraine's higher business court that on July 13 did not satisfy the claim declaring valid the ruling of a lower instance court and the appeal court.
