The District Administrative Court of Kyiv has declared illegal an order by the Ukrainian Emergencies Ministry on a mechanism of travel to the Chornobyl exclusion zone by Ukrainian citizens and foreigners that is not envisaged by the law on the legal regime of this territory, the media liaisons office of the Ukrainian Prosecutor General's Office reported on Friday.
"The said appeal was lodged in June this year, as the Ukrainian Emergencies Ministry rejected a protest by the Ukrainian Prosecutor General's Office against the specified mechanism. The court declared as justified the position of the prosecutor's office regarding the violation of the requirements of the law during its approval by the ministry," reads the statement.
In addition, the Prosecutor General's Office noted that the mechanism of travel to the exclusion zone, which was approved by Emergencies Ministry order No. 159 of February 18, 2011, had not been agreed with the Interior Ministry, whose subdivisions ensure the control and access regime during the entry to and exit from the zone, which violates the provision on the state registration of the legal acts of ministries and other executive agencies approved by the Cabinet of Ministers of Ukraine on December 28, 1992.
"In addition, this type of activity is not envisaged in the mechanism of the issuance of special permits for certain activities on the territory of the exclusion zone and the zone of unconditional (obligatory) resettlement, which was approved by a Cabinet of Ministers of Ukraine resolution of December 20, 2000," reads the statement.
