Pechersky District Court of Kyiv will continue considering the case against Former Deputy Defense Minister of Ukraine Valeriy Ivaschenko at 1100 on September 20 due to thehigh workloadof the court.
Judge Serhiy Vovk, who is presiding over the case, announced this decision on Friday, an Interfax-Ukraine correspondent reported.
Before announcing the break, the court considered a petition by Ivaschenko requesting the court to allow him to be present at the court's meetings not in a defendant's cage, but to sit on the bench next to his lawyers, since the procedure is humiliating for him.
The court dismissed this request saying that this matter is not in the jurisdiction of the court and is required under another procedure, which is beyond the scope of the criminal case.
"The court cannot exceed its jurisdiction," the judge said, adding that this decision is not subject to appeal.
Earlier today, Pechersky District Court of Kyiv rejected a petition lodged by the defense team of Ivaschenko to change the measure of restraint against him from arrest to a travel ban.
In its ruling, the court also asked the prison director to respond to complaints from Ivaschenko regarding the condition of his health.
As reported, on August 20, 2010, the Prosecutor General's Office opened a criminal case against Ivaschenko under Part 2, Article 364 of the Criminal Code of Ukraine (abuse of power or office).
Late in November 2009, Ivaschenko signed a bailout plan concerning the sale of the property of the Defense Ministry's state-owned enterprise Feodosiya Ship and Mechanical Plant, including strategically important infrastructure facilities.
On May 20, Ivaschenko was transferred from the detention center to an emergency hospital in Kyiv.
