Former judge of Kyiv's Pechersky District Court Oksana Tsarevych has appealed to the ruling of the High Administrative Court of Ukraine (HACU) following her dismissal by the head of state.
The HACU on Wednesday said the appeal was filed on Friday, September 30, the same day as her case was assigned to a judge.
As earlier reported, Ukrainian President Petro Poroshenko signed a decree to dismiss Tsarevych, a judge of Kyiv's Pechersky District Court, because of an oath violation.
On March 4, 2015 the Verkhovna Rada of Ukraine approved the arrest of three Pechersky district court judges, including Tsarevych. On November 18, 2015 Kyiv Prosecutor's Office said it had completed pretrial investigations of criminal cases involving Pechersky District Court judges Viktor Kytsiuk and Tsarevych, who were suspected of illegally persecuting members of the Automaidan (civil group active during protests in Kyiv in late 2013 and 2014. Tsarevych is suspected of violating Part 2 of Article 375 of the Criminal Code of Ukraine – delivering deliberately illegal verdicts against activists pursuant to Article 1222 of the Code of Administrative Violations.
The High Council of Justice, having reviewed a disciplinary case involving Tsarevych, decided to recommend to the president that she be dismissed. In their recommendation the council said Tsarevych in 10 cases against protesters was biased. The council said Tsarevych's rulings did not comply with her oath as a judge to be objective, impartial, independent and to justly dispense with justice, following only the law and being guided by the principle of rule of law.
