Court orders Kherson region energy supplier to return funds received through illegal tariff hike for military
A court in Kherson region, following a lawsuit by the specialized defence prosecutor’s office, has ordered an energy supplier to return UAH 7.7 million to the budget that was groundlessly paid for electricity for military units, the Office of the Prosecutor General said.
"The case concerns a contract concluded in April 2021 between the supplier and the Quarters and Exploitation Department of the city of Kherson for UAH 20.6 million. The parties subsequently signed ten additional agreements that gradually raised the electricity price, citing alleged changes in market conditions," the Telegram statement said.
The prosecutor’s office established that the price increases lacked proper justification. No documents confirming actual growth in electricity market prices existed. Despite this, the tariff rose by more than 80% while actual supply volumes decreased.
As a result, the state overpaid UAH 7.7 million.
In April 2026, the Commercial Court of Odesa region fully upheld the prosecutor’s office position. The court declared the additional agreements invalid and ordered the supplier to return the funds to the Ministry of Defence of Ukraine represented by the Quarters and Exploitation Department of the city of Kherson.
