Borschahivsky Chemical Pharmaceutical Plant seeks to recover UAH 50.7 mln from Russia over destruction of warehouse in 2025 shelling
PJSC Borschahivsky Chemical Pharmaceutical Plant is seeking to recover UAH 50.7 million in damages from the Russian Federation due to the destruction and damage of its property as a result of armed aggression, specifically the destruction and damage caused by a missile strike on July 31, 2025.
According to court materials in case No. 910/15066/25, copies of which are available to Interfax-Ukraine, on December 30, 2025, the plant filed a lawsuit with the Commercial Court of Kyiv against the Russian Federation, represented by the Ministry of Defense of the Russian Federation, seeking compensation for losses totaling UAH 50.760894 million caused by the occupying country’s armed aggression, namely the destruction and damage of a complex of buildings at a production base in Kyiv that was used by the company as a warehouse for storing raw materials.
On July 31, 2025, a massive missile attack on Ukraine took place; in particular, during the night of July 31, Russian forces carried out a missile and drone strike on Kyiv.
The court accepted the claim for consideration and opened proceedings in the case. As part of the investigation, an expert examination was conducted, according to which the amount of direct (actual) losses incurred by the Borschahivsky plant as a result of the loss, destruction, or damage of property (fixed assets and inventory according to the lists) due to the armed aggression of the Russian Federation (as a result of the explosion and fire on July 31, 2025) amounts to UAH 50.760894 million, which at the National Bank of Ukraine exchange rate on the valuation date (July 31, 2025) equals $1.215358 million.
In addition, the plaintiff submitted to the court, together with a motion to increase the amount of claims (accepted by the court for consideration), a copy of an expert opinion by Nauktekhproekt based on the results of a forensic complex construction and valuation examination, according to which, as of the date of the examination on January 19, 2026, the cost of restoration repairs of the destroyed and damaged structural elements of the warehouse building amounts to UAH 13.614240 million excluding VAT.
At a court hearing on April 1, 2026, the court completed consideration of the case on the merits and announced the introductory and operative parts of the decision, while the full decision, drawn up and signed on April 10, was published on April 13. By its ruling, the court fully satisfied the claim: to recover from the Russian Federation, represented by the Ministry of Defense, in favor of the Borschahivsky plant's damages in the amount of $1.215358 million, equivalent to UAH 50.760894 million, as well as damages in the amount of UAH 13.614240 million. It was also ordered to recover from the Ministry of Defense of the Russian Federation to the state budget of Ukraine court fees in the amount of UAH 956,627 thousand. After the decision enters into legal force, the court must issue the corresponding enforcement order.
Borschahivsky Chemical Pharmaceutical Plant was founded in May 1997 and is among the largest pharmaceutical companies in Ukraine.
According to the National Depository of Ukraine, as of the fourth quarter of 2025, 31.8134% of the Borschahivsky plant's shares are owned by Darnitsa Pharmaceutical Company, 20.3169% by Lenik Group S.A., and 21.2636% by Beldor Group S.A.
