Kyiv multi-apartment block co-owners unions say private housing services won't pass new buildings to management

KYIV. May 20 (Interfax-Ukraine) - Representatives of the associations of co-owners of the Kvartal 13 and Abrykos (Apricot) multi-apartment blocks in Darnytsky district of Kyiv have said that private housing maintenance organizations, related to the developers, have refused to pass new buildings to their management and that legislation is not regulating the issue.

"The situation is quite complicated, because it is completely out of the legal field. As a rule, developers transfer newly built facilities to management to their affiliated housing and utilities organizations, which in the future have no desire to pass these buildings to others, including the associations of multi-apartment blocks co-owners," Kvartal 13 project lawyer Vadym Kolokolnykov said at a press conference at Interfax-Ukraine.

According to him, the case with the association of multi-apartment blocks co-owners of Kvartal 13 at 13 Akhmatova Street, Rada LLC, which is associated with Pozniaky-Zhyl-Bud (both based in Kyiv), despite the creation in November 2014 of the association of multi-apartment blocks co-owners by its co-owners and the rejection of housing and utilities service rendered by Rada LLC, as well as the necessary agreements being signed with service providers, in particular with Kyivenergo, was appealed to the Darnytsky district court with residents being demanded to pay for services.

At the same time, he said that the Darnytsky district court requires residents to prove that Rada LLC did not provide services, which is a violation of their rights. The total cost of services for only housing and local area maintenance is about UAH 100,000 per month.
