Jemilev's son is guilty of premeditated murder – Russian prosecutors

Svetlana Nekoz, the state prosecutor in the trial of the case involving Khaiser Jemilev, the son of Ukrainian parliamentarian Mustafa Jemilev, which is being held in the Krasnodar Territorial Court, believes the accused to be guilty of theft, illegal storage and possession of firearms and munitions, and also that premeditated murder for 'hooligan' motives has been proven.

"The main question is whether this murder of Fevzi Edemov, an employee and friend of the Jemilev family, was premeditated or not. We insist that it was a premeditated murder and that it was committed for hooligan motives. It's not just an open challenge to society, it's also contempt of human life. Such crimes are often committed without any motives," the prosecutor said during the deliberations on Friday.

The prosecutor said Jemilev stole a rifle and scope along with ammunition from his father's residence in Bakhchisarai in May 2013. He took the weapons to his house, which is located nearby, and stored them in his bedroom.

"The accused fully admits the theft, illegal possession and storage of weapons and ammunition charge," Nekoz said.

She said Jemilev took the rifle on May 27, 2013 and started walking around the house, aiming at birds and other objects through the windows. He eventually shot Fevzi Edemov, a friend of the Jemilev family, who was working in the garden, in the head.

The defense lawyers for the accused also admitted that the qualification of the murder plays a key role in this criminal case. Lawyer Nikolai Polozov reiterated that the investigators have not determined the motives for the crime, which is characteristic of crimes committed by inadvertence.

The lawyer asked the jury to acquit Jemilev of premeditated murder for hooligan motives, recalling that the accused admits to being guilty of manslaughter.

On Wednesday, the Krasnodar Territorial Court declined the defense lawyers' request to throw the case out of court on the grounds that Jemilev has already been sentenced for his crime in Ukraine.

The Kyiv Dnipropetrovsk District Court on April 10, 2015 found the Ukrainian parliamentarian's son guilty of the theft and illegal storage of weapons and munitions, and of manslaughter. The court sentenced him in absentia to three years and eight months in prison. The sentence took legal effect in May. The Ukrainian Justice Ministry has filed an extradition request for Jemilev with the Russian Prosecutor General's Office.

Khaiser Jemilev, 34, is the son of Mustafa Jemilev, Ukrainian parliamentarian and former leader of the Crimean Tatar Mejlis.
