Justice ministry asking court to collect UAH 705 mln from Linik

The Justice Ministry of Ukraine has filed a lawsuit to the business court in Luhansk region seeking to collect UAH 705 million from private joint-stock company Linik (Lysychansk oil refinery, Luhansk region) as recourse in the lawsuit of Agrocomplex lost in the European Court of Human Rights (ECHR), Deputy Justice Minister Serhiy Shkliar said at a press conference in Kyiv on Tuesday.

"The lawsuit appeared as the ECHR decision was to be executed. EUR 27 million was paid from the national budget. Now the lawsuit amount is UAH 705 million, taking into account interest. The lawsuit has been filed. Yesterday a first preparatory hearing was held. The break until February 12 was announced. We filed petitions, including one seeking to arrest the property of the defender… The court has not yet decided on the petitions," he said.

As reported, the owner of Linik is Rosneft.

ECHR, which in 2011 recognized Agrocomplex company the injured party in a lawsuit for overdue debts against Lysychansk oil refinery, after two years has ruled that EUR 27 million in fair compensation be paid to Agrocomplex. The funds were paid in the two year term.

The written decision of the ECHR notes that during the events, Agrocomplex private company carried out barter operations to exchange Ukrainian food raw materials for Russian crude oil with Russian companies for the further sale of finished petroleum products. The case concerned the bankruptcy procedure of 1996-2004, initiated by the applicant against the largest oil refinery in Ukraine in the attempt to recover overdue debts.
