Gas supplies from Slovakia to Ukraine maintained irrespective of gas arrest in litigation with IUGAS

Natural gas from Slovakia to Ukraine are supplied as usual, public joint-stock company Ukrtransgaz has told Interfax-Ukraine.

Naftogaz said that the company is settling the situation.

"Gas is transported through the Ukrainian GTS [gas transport system] as usual, as well as gas delivery to Ukrainian consumers," Naftogaz said.

Slovakia's gas transportation operator Eustream said that gas supplies from Slovakia to Ukraine on December 1 through December 21 were in the amount of 21-22 million cubic meters a day.

Earlier Dzerkalo Tyzhnia weekly reported, referring to its source, that the Slovakian court on December 20, 2017 arrested gas supplies from Slovakia to Naftogaz Ukrainy under a claim of Italy's IUGAS to execute the decision of the Arbitration Institute of the Stockholm Chamber of Commerce in litigation with Italia Ukraina Gas S.p.a. (IUGAS, Italy).

The Arbitration Institute of the Stockholm Chamber of Commerce decided to fine Naftogaz Ukrainy $12.7 million for non-fulfillment of contract liabilities to IUGAS in the period from September 1, 2008 through December 31, 2010. The court said that in the period before September 1, 2008, Naftogaz is not responsible for the non-supply of natural gas, as IUGAS did not submit applications for gas deliveries.

The court also decided that in the period from 2011 through 2012 Naftogaz Ukrainy was not responsible for non-supply of natural gas, as there were circumstances beyond control of the company. The arbitration court also did not make the decision on deliveries of natural gas in the last year when the contract was in effect – 2013.
