Higher administrative court decides not to suspend decision to return deposits of Surkis family by PrivatBank

The higher administrative court of Ukraine has approved the counterclaim of PrivatBank and the National Bank of Ukraine (NBU) on launching the hearing under their counterclaim against a ruling of Kyiv's district administrative court dated May 17, 2017 and a ruling of Kyiv's administrative court of appeals dated November 6, 2017, obliging PrivatBank to return UAH 1.05 billion, $266,200 and EUR 7,800 to the Surkis family.

According to the unified register of court rulings, the court made the decision on November 16, 2017.

However, the court decided not to suspend the execution of the rulings of the above-mentioned courts as PrivatBank and the NBU asked.

As reported, on December 18, 2016 the government at the suggestion of the NBU and PrivatBank shareholders, the largest of whom at that time were Ihor Kolomoisky and Hennadiy Boholiubov, decided to nationalize this largest financial institution in the Ukrainian market. The state received 100% of its capital, and PrivatBank was capitalized for UAH 116.8 billion.

As part of the nationalization of the bank its liabilities to affiliated persons were involved in the bail-in procedure and were exchanged to the additionally issued shares.

Ihor Surkis and his brother Hryhoriy Surkis, as well as other persons affiliated with PrivatBank, filed 42 lawsuits against the NBU.
