Court annuls competition agency's fines of UAH 1.3 bln imposed on Ukrtatnafta, Halychyna oil refinery

Kyiv's business court has annulled decisions of the Antimonopoly Committee of Ukraine to collect UAH 1.03 billion from public joint-stock company Ukrtatnafta, UAH 326.929 million from Halychyna oil refinery and UAH 41.744 million from four more companies for concerted action on the sale of Ukrainian oil at auctions in March-July 2015.

According to the court rulings dated August 7, 2017, the court rejected evidence of the committee.

The court believes that the committee did not investigate into the circumstances of concerted actions of the bidders, in particular, the way how they could concert their actions, exchange information and coordinate steps during the auctions.

The court did not agree with the conclusions of the committee that the bidders were affiliated with each other and statements that the bidders concerted their actions via the provision and receiving of financial assistance.
