Court postpones hearing on Kolomoisky's claim against NBU on unlawfulness of nationalization of PrivatBank

Kyiv's district administrative court at a hearing on Tuesday postponed the hearing of a claim filed by Ihor Kolomoisky against the National Bank of Ukraine (NBU), the Individuals Deposit Guarantee Fund, the Cabinet of Ministers and the National Commission for Securities and the Stock Market seeking to declare unlawful the nationalization of PrivatBank and annul the decision.

The decision was made in response to a petition of the Deposit Guarantee Fund, a representative of which said that the fund until now has not yet received a copy of the claim and the order to launch the proceedings.

"We have learnt that the hearing will be held today from the register. We have a petition asking to announce a break in the preliminary court hearing," the fund representative said.

The judge did not specify the date of the next hearing.

Managing Partner of Asters law firm Oleksiy Didkovsky who represented the NBU in court told Interfax-Ukraine that the claims were not announced at the hearing, but they are trying to prove the unlawfulness of steps of the NBU, the Deposit Guarantee Fund and the Ministry of Finance related to the nationalization of PrivatBank.

He believes that the claims are farfetched.

"There is an address of former shareholders seeking support of the bank – a letter dated December 16, where it is clearly said and the NBU stuck to it," Didkovsky said.

He said that at present around 75 claims of former owners of PrivatBank or affiliated persons against the NBU and other government agencies has been registered. He said that the figure is permanently growing and soon could exceed 100.
