Government intends to relax requirements for business concentration

The Cabinet of Ministers intends to increase cost parameters if businesses must apply to the Antimonopoly Committee of Ukraine (AMC) for permits for business concentration and the assessment of concentration effects on competition.

This is stated in the action plan for economic activity deregulation approved by Cabinet order No. 357-r dated March 18, 2015.

The Cabinet noted that for this purpose the Antimonopoly Committee and other central executive authorities should no later than the third quarter of 2015 submit to the government draft amendments to the law on economic competition protection.

Under the current law, AMC permits for business concentration are necessary if the total value of assets or total goods sales by concentration parties for the last fiscal year, including those abroad, exceeds the equivalent of EUR 12 million and the same performance of at least one participant exceeds the equivalent of EUR 1 million.

The deregulation action plan also foresees that the Ministry of Economic Development and Trade, together with the Justice Ministry, should by July 2015 submit a bill to the Cabinet, which will determine the list of administrative services and fees for their provision.
