Court upholds lawfulness of current procedure for flight assignments

The administrative court of appeals in Kyiv has declared valid order of the Infrastructure Ministry No. 245 of April 23, 2013 which approved the current procedure for assigning airlines to air routes and canceling the assignments by the commission for the formation and realization of the state policy on exploiting air routes, which consists of representatives of the ministry and the State Aviation Service of Ukraine.

This is stipulated in a court ruling of January 20, 2015 in case No. 826/12976/14.

According to the ruling, the mechanism for assigning Ukrainian and foreign airlines, irrespective of forms of ownership, to air routes, canceling the assignments and amend them is obligatory for observation. The mechanism is used to regulate access of airlines to the air transportation market and it was approved in Infrastructure Ministry order No. 245.

"The commission for the formation and realization of the state policy on exploiting air routes is a body empowered to decide on assigning airlines to air routes, canceling the assignment and amending it," reads the ruling.

The court did not satisfy a claim of Atlasjet Ukraine airline which asked to deprive Ukrainian International Airlines (UIA) of some assignments to air routes and leave the ruling of the district administrative court of Kyiv in effect.
